[Advisors] How corporations and their industry associations use lobbying to influence public policy in Canada

and you have a fairly accurate picture of current economic strategy =
planning in the federal government.


Most of you know I work on broadband development in Alberta.=20

Over the last decade, I have gained line-of-sight perspective on =
leadership in Canada's oil and gas industry.

This was a matter of necessity rather than choice, because this is the =
only leadership that seems to matter these days in Alberta or Canada as =
a whole.

Here's what I see.


International scrutiny and criticism have seriously damaged the =
industry's reputation, forcing industry leaders to re-think their =
longstanding 'Industry =DCber Alles' strategy for creating shareholder =
value.

This awakening took surprising form last week when a senior industry =
leader publicly acknowledged that his company must act in the interests =
of all of its stakeholders, not just its shareholders (see article =
below).=20

It remains to be seen whether this will translate into a meaningful =
shift in operating practices across the industry, including practices in =
government lobbying.=20

My expectation is that cynical industry operators will leverage our =
hapless federal government as a foil, arguing that they cannot make =
substantive changes to the way they operate unless the government =
changes with them (=3D captive policy and regulator).

Following this lead could seriously damage the Harper Government's =
credibility (increasingly tenuous), as it would conflict directly with =
its ideological foundations and de facto operating objectives.=20


As for the Government's relationship with the oil and gas industry, more =
Canadians are getting fed up with crippling cynicism on both sides, and =
the utter lack of leadership around charting a meaningful course for the =
country's economic future.

We're still just a growing trickle, but even if we were a flood it would =
be practically inconceivable that leaders on either side could respond =
effectively to a groundswell of demand for meaningful change.

The Harper Government literally cannot think outside of Canada's current =
economic box, which is why the cartoon below is so apt (from the Globe & =
Mail).

The only meaningful strategic capacity they have is in the PMO, for =
which 'Strategic Economic Planning Center' is a pseudonym in the cartoon =
below.


Meanwhile, most leaders in the oil and gas industry are similarly =
afflicted with an insensitivity to rapidly changing realities outside of =
their operating environments (very strong inward focus).

Most of these leaders are technical people whose drive and expertise =
relate to producing and delivering oil and gas at the lowest cost to the =
enterprise, and most would happily ignore external social, environmental =
and economic costs if they could.

They much prefer to talk about the wealth they create, and they =
genuinely believe it is Canada's privilege to host these wonderful =
wealth-producing enterprises.

Few leaders see it as a privilege for their enterprise to profit from =
exploitation of resources that belong to everybody (or nobody).=20

I expect this particular condition to cause the industry serious grief =
in the next two years.

Production royalties must increase, and industry observers know this =
will be a catalyst for social conflict.=20

The industry is setting itself up for an even nastier beating, this time =
in the court of domestic public opinion.


These issues around social risk are difficult enough for the industry to =
deal with, but then there is the rapid growth in production from =
fractured shale.=20

In terms of production, transportation and refining costs, only the very =
cheapest oil from the oil sands can compete with this rapidly expanding =
source of oil.

The light crude coming out of the Bakken shales below southeast =
Saskatchewan and North Dakota is almost ready to put in your tank.=20

Predictably, Suncor has just announced it will be scaling back its oil =
sands development plans for the foreseeable future.=20

Investment in the oil sands has become a very high-risk proposition, =
though you wouldn't know it from the $billions that are still being =
invested every month.


Then there are the colossal risks to fossil energy industries around the =
world related to global warming (--> carbon tax) and plummeting costs of =
producing energy from any number of alternative and renewable sources.=20=


Rest assured that the U.S. Government is up to speed on these risks, and =
that they recognize the momentous policy decisions they face.

Incentivize a dying fossil energy economy, or a growing sustainable =
energy economy?

This decision will have economic implications for the rest of the world, =
but especially Canada.=20

It could all come down to the decision about the Keystone XL pipeline, =
and there is a lot more riding on that decision than most of us might =
think.

Building the pipeline would keep the price of fossil fuels in the U.S. =
artificially low, greatly weakening incentives for consumers to invest =
in technologies that use more expensive alternative fuels.

Not a wise move when the rest of the developed world (except Canada) is =
already weaning itself off of fossil fuels, and the so-called developing =
world is building up speed to leapfrog us.=20


Here in Canada, government and industry still appear to be in denial or =
paralysis about these latter threats... but is this their fault?

Most voting Canadians remain ignorant or indifferent to the rapidly =
changing economic and political realities beyond Canada's borders.

This is why the petro-state polemic served up by the Polaris Institute =
likely won't make a noticeable dent in our anemic national discourse.

It's also why leadership at the community level is the only leadership =
that is making any meaningful difference in Canada.

We just need a hell of a lot more of it, and that's where I think we =
should all be channeling our energy.=20

Murray Edwards signals a shift in allegiance; Canadian Natural must act =
in the interest of stakeholders, not just shareholders, chairman says

It has long held the force of a mandate from on high: a company must act =
in the best interest of its shareholders.
But Canada's beaten-up energy industry is revising that mantra. Faced =
with an onslaught of opposition, and a dawning realization that its =
future depends as heavily on governments, first nations and even =
environmental critics as it does on markets - at least one company is =
giving the old phrase a crucial edit.
"=46rom Canadian Natural's perspective, our view is we have to do what's =
in the best interest of our stakeholders," Murray Edwards, chairman of =
Canadian Natural Resources Ltd., told reporters last week.
Catch that? Stakeholders, not shareholders.
It might seem like a meaningless shift. But the interests of =
stakeholders are far more broad than the narrowly profit-focused =
interests of shareholders. And for CNRL, that altered view of the world =
has helped influence where it directs huge amounts of spending. The =
company is a 50-per-cent partner in construction of a $5.7-billion =
diesel refinery not far from Edmonton. It gave the go-ahead to project =
several weeks ago, placing it in the unusual position of building a new =
refinery - or upgrader, as CNRL calls it - when most of North America =
has abandoned refinery construction for decades.
Why do it?
In part, CNRL thinks it can make money. It's negotiated a solid - some =
might say sweetheart - deal where it will provide 25 per cent of the =
bitumen to be refined, with the remainder coming from the province of =
Alberta. The refinery will operate on a tolling basis, where there is a =
set price to refine every barrel. That gives CNRL substantial assurance =
that it will make enough money to cover capital costs and turn a profit =
irrespective of market conditions or oil price - although Mr. Murray =
said it's not an iron-clad revenue guarantee, since the company will =
have to meet certain performance standards.
But there's another reason, too, for building the refinery. And if Mr. =
Edwards is to be believed, it's an unusual one: CNRL wanted to direct =
money in a way that proves to Albertans that it's building things people =
want to see.
"The province clearly has set as a priority to have more value-added in =
Alberta," Mr. Edwards said. He added: "clearly, investing in the =
upgrader is done with an eye toward an economic return. But I think as =
an industry leader, it's also important to work with governments and =
develop projects that reflect public policy."
More to the point, this was partially about making happy a part of the =
province whose dissatisfaction with the energy industry has caused it =
pain recently. A desire by rural Albertans to pluck more money from oil =
and gas royalties sparked a provincial royalty grab several years ago =
that, while later reversed, brought significant turmoil.
"A lesson that I learned through the whole royalty debate was that =
throughout the province, there are different views of the industry," Mr. =
Edwards said. Calgary cares about pumping more barrels. Other parts of =
the province care about extracting more value from those barrels, in =
part by refining or upgrading them.
"So I felt that the industry should find a way to become more proactive =
on the upgrading side, because that's clearly a bigger issue in Edmonton =
and rural Alberta than it is in Calgary."
